Common terms for users to  Internet - shop "Nikom Light" - owned by " Nikom Group" Ltd.

TERMS OF USE OF THE SERVICES PROVIDED BY THE TRADER

I. GENERAL

1. This document contains the general conditions according that the trader - Nikom Group Ltd. provides services to the users / customers through the Internet shop / Nikom Light / . These conditions are common and binding to all users.
2 . Identification of the user / customer for reproduction of the statement for acceptance of the Terms and for the made order  is made by the saved in the log - file server / Nikom Light /, store of  the IP address of the user / client and any other information as well .
3 . The products listed on the website  of /Nikom Light / do not present a legally binding offer, but  rather demonstrative online catalog describing the product line of the trader.
4 . After clicking the button " Add to Cart"  and then "Complete Order", the users agree to buy the goods added in the cart. This action is legally binding .
The customer receives an order confirmation and receipt of such confirmation shall be considered as a contract conclusion .
5 . If the ordered products are out of stock the dealer reserves the right to refuse delivery of the confirmed order. For the ordered products that are out of stock within the workweek the trader  notifies the user / client by sending a message to the customer's  email address or the given by the client telephone number .
In case of already made payment to the account of the trader, the customer can choose between:  payment refund, refusal of the ordered products or a replacement of the order.
6 .The contract is in Bulgarian, the relevant payments will be made in Bulgarian leva with
VAT.

II. DELIVERY

7 . The user/customer bears entirely the risk of damage or loss of the goods upon delivery.
Immediately after delivery of the goods to  the courier the dealer shall be dispense from responsibility that  transferred to the user / client . TRADER is not responsible for delay in delivery  in case the last is due to a courier or other supplier.
8 . Immediately after delivery, the goods should be carefully reviewed by the
user / client or authorized person. Any damages  should be reported immediately to the trader. The trader is not responsible for the warranty service on this product for any damages occurred during the transportation of the goods. If there are given in written form specific date and time for delivery from the trader, the statement is binding . For incorrect or wrong address, contact person and /or phone, the trader  is free from any obligation to perform the contract.
8a . Upon delivery of the goods the client or third person sign the accompanying documents. For a third party  is considered anyone who is not the holder of the application, but present at the time of the delivery and is on the specified by the customer address.
In refusal to receive the goods,  excluded  the cases described below, the refusal is considered
unfounded and the client has to cover the costs of delivery and return of goods.
If the client is not at the given address  within the time of delivery or
there is no access and conditions for delivery of the goods within this period, the trader is no longer obligated to deliver the goods for purchase.
8b. If  the delivered goods  does not correspond to the purchased  by the Customer goods and it is obviously by an ordinary review,  the client has the right to ask for delivery of the corrected  goods  within 24 hours of receiving the order.

III. WARRANTY TERMS

The trader offers a warranty document to its customers for a purchased item if
this document is provided by the manufacturer of the product. The document describes : address and telephone of the authorized repairers, the warranty conditions of the respective service centers or manufacturers, warranty period on purchased by the user / client article.

IV. PRICES

9. The prices listed on the site include packaging and transportation across the country.
The transportation in the country is free. In case the goods are sent outside the Republic of Bulgaria, the client should pay all customs and others charges related to exports.

V. RIGHTS AND OBLIGATIONS OF THE USER / CLIENT

10 . The user / client has the opportunity to look through and / after registration / to order the listed in the internet store Nikom Light  goods.
11 . The user / client has the right to know the status of your order .
12. The user / customer assumes full responsibility for the protection of his username and
password and for all actions performed by him or by a third party using the username and the password . The user shall immediately notify the trader in case of illegal access using his username and password and whenever there is a risk of such use .

13. The user is obliged to pay the price of his order according to the declared way on the page Nikom Light .

14. Any user or a customer of the trader  has to:

• not to violate and to respect the fundamental rights and freedoms and human rights ,
under the Constitution and laws of the Republic of Bulgaria and recognized international acts;
• to keep the good name and the reputation of others and does not call for a violent change  or acts, to commit a crime , to violence or incitement of racial, national, ethnic or religious hatred ;
• not violate foreign material or immaterial, absolute or relative rights and interests, ownership, intellectual property, etc. ;
• to comply with Bulgarian legislation, the applicable foreign laws, rules and morals
good manners and netiquette when using the services provided by Nikom Light services;
• notify the merchant in case of infringements in use of the provided services;
• not to load, send, transmit, distribute  and not make ​​available to third -party the software , computer programs, files, applications or other materials containing computer viruses, unauthorized remote systems control ( "Trojan horses" ), computer code or materials designed to interrupt, impede, distort or restrict the normal functioning of the computer hardware or software or telecommunications equipment or aiming at unauthorized penetration or access to
foreign resources or software;
• do not perform malicious actions;
• compensate the trader and all third parties for damages and lost profits including all costs and attorney fees paid as a consequence of claims by and  or compensations paid to third parties in connection with websites, hyperlinks, materials or information that User is used, placed on the server, sent, distributed, made ​​available to third parties or made available
by /site name / in violation of the law, these Terms, etiquette Net etiquette ;
14a . Customer shall designate an accurate and valid phone, shipping address and email
address, to pay the price of the goods, to cover the costs of delivery (in the case the delivery is not free)  and provide access and opportunity to receive the goods.

VI. RIGHTS AND OBLIGATIONS OF THE TRADER

15 . The TRADER is not obligated and is not able to control the way, the consumers use the provided services.
16. The TRADER  has the right, but not the obligation to keep the information and materials located on the server Nikom Light .
17. THE TRADER may, at any time, without notifying the user / client in case of violation acts,  to terminate, suspend or change the services provided in connection with the use of
site. TRADER is not responsible to users and third parties for damages and benefits lost as a consequence of the termination, suspension, modification or limitation of services, deletion , modification, loss, lack , inaccuracy or incompleteness of messages  materials or information,
recorded or made available through  the /site name /.
17a. THE TRADER transfers the ownership of the article to the user after receiving the payment,  to deliver within the requested period, to check each item before shipment ( in the case that it is possible, without compromising the integrity of the package) .

18. THE TRADER  is not responsible for damages caused to the software , hardware or
telecommunications equipment, or for any loss of data arising from materials or resources
searched, downloaded or used in any way by the services.
Advices, counseling or assistance rendered by specialists and employees of the trader, do not present any TRADER' s obligations. The Company is not liable for infidelity of manufacturer information on this product.
19. THE TRADER may collect and use information relating to its Users /customers, whether they are registered or not.

20. The information in the preceding article may be used by the trader, except for official disapproval of the user, sent the following e-mail address: help@nikomlight.com. THE TRADER collects and uses information to improve its services. All purposes used by the trader  will be in compliance with Bulgarian legislation, applicable international instruments and good manners.

21. Trader is not liable for breach of  his obligations under this contract in occurrence of circumstances that the trader has not provided and was not obliged to provide -
incl., cases of accidental events, problems in the global network of the Internet in providing
services beyond the trader's control.

22. The TRADER  may install on users' computers cookies. Cookies are text files that are stored on the website on the User's  hard disk and to  allow recovery of information to the consumer, identifying  and  allowing control on the visited Internet pages, hyperlinks and  the information used and recorded.

VII. PERSONAL DATA

23. THE TRADER ensure its users / clients confidentiality of  provided information and personal data. The latter will be used, provided or brought to knowledge of third parties outside the cases and under the conditions set out in these Terms and Conditions.
TRADER protect the personal data of the user / client this obligation shall cease if the customer has provided incorrect data. The trader may use the personal data of the Customer
solely for the purposes specified in the contract. Any other cases for data use data will be in accordance with Bulgarian legislation, the applicable international instruments, internet  ethics, morality and decency .

23a THE TRADER  undertakes not to disclose any personal customer data to third parties -
government bodies, companies, individuals and others, unless it is received a written consent of the Client, the information is required by government bodies or officials, according to current legislation, to require collect such information. The trader is obliged to provide the information under the law.

VIII. AMENDMENTS

24. Terms and Conditions may be modified at any time by the trader, who has the right to
change the characteristics of the provided services , the Terms and according changes in the legislation. The TRADER undertakes to inform the Customer of the changes in the
General conditions,  publishing a message amendments on the general page of the site and to give sufficient time to the clients to become familiar with them. If there are any rejections from the clients within the given period,  it is considered bound by them. In the event that in the given deadline, the user is not agree with the changes, the trader may immediately suspend or stop providing the service to the consumer.

IX. TERMINOLOGY

25. Under "User / Customer" means anyone visited the website Nikom Light on his computer.

26. By "Order" means selection of goods and other articles, related to delivery and payment for the goods by the customer / user.

27. The Internet store Nikom Light is owned by the TRADER.

28. All disputes between the parties shall be resolved in a spirit of understanding and good manner.  In case the agreement cannot breached, all outstanding disputes, including disputes arising from or relating to the interpretation, performance or termination, as well as disputes
to fill gaps in the contract or its adaptation to newly arisen circumstances,
shall be resolved by the competent court of registration, in compliance with Bulgarian
legislation.
